1. General

This website www.brildor.com is the property of BRILDOR SL with VAT registration no B03308681 and tax address at CL CONSTITUCION PG INDUSTRIAL DE BENIMARFULL 7 03827, BENIMARFULL (ALICANTE) - SPAIN.

The General Terms and Conditions for the Sale of Goods regulate the online sales relationship between BRILDOR SL and the user or client, in accordance with the legal stipulations, in particular, Law 7/1998, of 13 April, on General Terms and Conditions for the Sale of Goods, Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights, General Data Protection Regulation (EU) 2016/679, Law 7/1996, of 15 January, on the Regulation of Retail Trade, and Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce.

BRILDOR SL reserves the right to make any modifications it deems appropriate, without prior notice, to the General Terms and Conditions. Such modifications may be made, through its websites, by any legally admissible means and shall be binding for as long as they are published on the website and until they are validly updated by subsequent modifications. Nevertheless, BRILDOR SL reserves the right to apply, in certain cases, Specific Conditions for the Sale of Goods in preference to the present General Conditions when it deems it appropriate by announcing them in due time and form.

The purpose of the website is: Sale of blank products, machinery and consumables for different techniques.

The duration of the contract will be linked to the delivery of the product without prejudice to the right of withdrawal

As a user or customer, you expressly declare that you know, understand and accept the conditions of use and these General Terms and Conditions for the Sale of Goods. Likewise, you declare to be of legal age and to have the necessary legal capacity to access the BRILDOR SL websites and to purchase through them.

You can register as a website user to make an online purchase in the corresponding section of the website. In accordance with the applicable and current legislation on data protection, BRILDOR SL informs users that the personal data collected during the registration process and subsequent purchase, will be incorporated into the processing system owned by BRILDOR SL, in order to process such actions by the user and manage subsequent actions arising from them.

Your data will be kept for the period of time strictly necessary to comply with the aforementioned purposes, unless there is a legal obligation to keep them.

We inform you that the legal basis for the processing of your data is the correct execution of the contract between the parties and consent.

In accordance with the rights conferred by current data protection legislation, you may exercise your rights of access, rectification, limitation of processing, deletion, portability and opposition to the processing of your personal data, as well as the consent given for the processing thereof, by sending your request to the address mentioned above or by e-mail to customersupport@brildor.com

2. Offer and Validity

In the case of a product on offer, the offer price and the validity of the offer will always be indicated, together with its main features.

In compliance with the regulations in force, BRILDOR SL provides information on all items on sale, their characteristics and prices. However, BRILDOR SL reserves the right to withdraw, replace or change the products offered through its website, by simply changing the content of the website. In this way, the products available on the website will be governed by the General Terms and Conditions in force at any given time. Likewise, the company shall have the right to stop offering, without prior notice and at any moment, access to the aforementioned products.

3. Essential Product Characteristics

The products offered in our online shop, include a photograph and the essential characteristics of the same, this is the information obtained from the manufacturer itself. The colour of the product, observable in the photograph is not binding. It is specified in the characteristics of the product.

4. Limited Warranty

All products offered on the website are covered by the commercial guarantee of the supplier of the product. BRILDOR SL has an after-sales service, while the warranty is in force, the customer may execute it by contacting the BRILDOR SL establishment, the after-sales service, by email to customersupport@brildor.com or to the points established by the supplier itself. In case of doubt, the customer may contact the customer support telephone number +34966516572 or by e-mail to customersupport@brildor.com.

If you receive perishable products that are in poor condition or out of date, please contact customersupport@brildor.com. You must follow the instructions on the packaging and the expiry date, keeping the receipt of purchase in any case.

BRILDOR SL informs that it offers a guarantee of 1 year for manufacturing faults in the machinery, except when the manufacturer indicates otherwise. In the case of second-hand or reconditioned products, this guarantee will be of 6 months, unless otherwise specified in the product sheet. Consumables have no warranty.

Our technical service is provided on our premises. The cost of sending the machine to our headquarters and returning it to your workshop is covered within the warranty period. If the warranty has expired, the shipping costs will be borne by the customer.

5. Price

All products indicate the selling price in Euros and do not include Value Added Tax (VAT). If any other tax is applicable, this would be indicated.

6. Delivery and Transport Costs

BRILDOR SL ships to:

Spain, Germany, Andorra, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Slovakia, Slovenia, Estonia, Finland, France, Gibraltar, Greece, Hungary, Ireland, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Macedonia, Malta, Monaco, Norway, Netherlands, Poland, Portugal, United Kingdom, Czech Republic, Romania, Serbia, Slovakia, Slovenia, Sweden, Switzerland.

BRILDOR SL indicates the corresponding shipping costs.

Gibraltar

All invoices from customers based in Gibraltar are exempt from VAT.

Due to excessive customs charges we do not ship direct to Gibraltar. These orders must be collected from the agency's office in La Línea de la Concepción, so there are lower shipping costs and no customs clearance.

International shipping

Our main market is Europe. Outside this area we only ship to a limited list of countries listed above. Before placing your order, please check if your country is on the list.

The shipping cost calculated in the shopping cart is based on door-to-door shipping but does not include, if any, customs clearance costs or taxes in the destination country (DAP Incoterm).

There are a few products that we can only sell in Spain due to the distribution agreements we have with our suppliers. We have indicated "Only available in Spain" at the end of the header of the product sheet.

The transport rate applied is an estimate and may be increased by the difference between the real weight and the volumetric weight, by the morphology of the package, by the current transport situation, or by many other factors. If this is the case, we will inform you of this difference and offer you the best options to go ahead with your shipment or to cancel it if you prefer.

For shipments outside of Spain, items will be dispatched as soon as all components are available. You can place one order for the products you need most urgently and another for the rest of the material. Please note that the shipping costs will be calculated separately for each order.

7. Payment Methods

The customer may pay the amount of their order by choosing any of the following methods of payment. You must indicate your preferred method at checkout:

VISA or MASTERCARD credit card

All operations involving the transmission of personal or bank details are carried out using a secure environment, a server based on standard SSL (Secure Sockets Layer) security technology. All the information you transmit to us travels encrypted through the network.

Likewise, your credit card details are entered directly on the bank's website, at the bank's POS (Point of Sale Terminal) and are not entered or registered on any BRILDOR SL server.

When paying by VISA or MASTERCARD you will always be asked for the following data: the card number, the expiry date, and a Validation Code that matches the last three digits of the number printed in italics on the back of your VISA or MASTERCARD, providing, in this way, more guarantees about the security of the transaction.

This payment method is only valid on the website.

When the amount of a purchase has been fraudulently or improperly charged using the number of a payment card, the cardholder may demand the immediate cancellation of the charge. In such a case, the corresponding debit and credit entries will be made as soon as possible on the accounts of the supplier and the cardholder.

However, if the purchase has actually been made by the cardholder and the demand for refund is not the result of exercising the right of withdrawal or termination and, therefore, the cardholder has unduly demanded the cancellation of the corresponding charge, the cardholder shall be liable to BRILDOR SL for compensation for the damages caused as a result of such cancellation.

Bank Transfer

For bank transfers we charge a transfer fee of 1% on orders under €500 before VAT for administrative costs.

When selecting the bank transfer you will receive, together with the confirmation of your order, an e-mail with BRILDOR SL's bank details.

It is very important that when making the transfer you indicate in the subject line the order number, as well as your name and surname, and that you make the transfer within 7 days after the order confirmation date to validate it.

If you wish, you can send us proof of the transfer by e-mail to customersupport@brildor.com. But in any case, the order will not be considered effective until our administration department has received confirmation of the bank transfer.

We would like to remind you that payment must be made in EUROS and that all possible exchange and bank charges are at your expense.

In the case of bank transfers made from outside Spain, it is very important that when ordering the transfer, you always inform your bank to take charge of the commissions at origin, those bank commissions and expenses corresponding to your bank. Otherwise, BRILDOR SL could block the shipment of your order if we do not receive the full amount of your order..

Any exchange and bank commissions shall be borne by the customer.

PayPal

When paying by PayPal we charge a 2% fee (that PayPal charges us). On the other hand, PayPal charges €1 to customers who pay by credit card through PayPal without having a PayPal account, which is then returned to them; those who have a PayPal account are not charged anything.

PayPal allows you to send payments securely and conveniently online. The PayPal network builds on the existing financial infrastructure of bank accounts and credit cards to create a global real-time payment solution. PayPal offers a service specially designed for those who are not satisfied with traditional payment mechanisms.

8. Delivery Performance

BRILDOR SL informs about the following delivery time according to the destination:

  • International: Delivery times for shipments to a European Union country are 2 to 7 working days, depending on size and weight. Small shipments (up to 3-5 kg) are shipped by air cargo and their expedition is faster. Please contact us for more precise information. We do not ship partial orders. In other circumstances, delivery times may be longer. If the destination is not peninsular the transit time will be longer depending on the destination. Before placing your order, please contact our Customer Service Department.

BBRILDOR SL informs that delivery times only include working days at origin and destination. It should also be taken into account that delivery times may be extended due to logistical problems with the transport company.

The availability of the products offered by BRILDOR SL may vary depending on customer demand. Although BRILDOR SL updates its stock periodically, the product requested by the customer may be out of stock at that moment. In case of unavailability, BRILDOR SL will notify the customer by e-mail as soon as it becomes aware of this situation. The period of this communication shall in no case exceed a maximum period of 30 days. BRILDOR SL will be able to give the customer the double option of: supplying a product of similar characteristics or of superior quality without price increase, or, except for justified and demonstrable reasons by BRILDOR SL within the same period, refunding the sums paid for the cancelled order.

9. Cancellation Rights

The customer will have a period of fourteen calendar days to cancel, from the day the customer receives the product, with no penalty and no indication of the reasons for the cancellation.

bor by using the Cancellation Form.

According to the provisions of Article 103 of Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, the supply of services or goods made according to consumer specifications or clearly personalised, or which, by their nature, cannot be returned or may deteriorate or expire quickly, are exempt from withdrawal.

10. Return of Goods

The deadline for requesting a return is 30 calendar days from the date of delivery of your order.

BRILDOR SL informs of the following return costs:

  • Outside peninsular Spain the goods will have to be shipped by your transport company, using the Incoterm "DDP Benimarfull", i.e. the customer will be responsible for all shipping and customs costs.
  • If the reason for the return has not been caused by BRILDOR SL, you will have to send the goods through your agency taking care of the costs of shipping and return.

BRILDOR SL indicates that only the following returns will be accepted:

  • Returns of unused products, in their original condition and in the same original packaging.
  • We will not accept the return of machines that have had their serial number registered on the manufacturer's website or downloaded their software, as once this has been done, the machine is permanently and irreversibly linked to the customer. On most machines you can use the free 30-day trial version. We recommend that you try the trial version before downloading the software.
  • Regarding the cutting service, we do not accept returns, as the product has been manipulated, except for product defects. In the case of heat transfer vinyl, we accept returns for cutting service if you have purchased 5 or more metres.

11. Payment Refund

The refund of the amounts received by the customer will be made using the same means of payment used by the customer, unless otherwise stipulated.

BRILDOR SL will refund the amounts paid by the customer within 14 calendar days from the date of receipt of the right of withdrawal.

BRILDOR SL may withhold the refund until it has received the product, reason for withdrawal, or until the customer provides proof of return of the product, depending on which condition is met first.

12. Termination

BRILDOR SL informs that for orders of products produced on demand, once the order has been formalised, it will not be possible to cancel it if it has already entered the production phase. Therefore, the amount paid for the production service is not refundable, as we are unable to sell products produced on demand.

13. Return Faulty Goods

The deadline for requesting a return is 30 calendar days from the date of delivery of your order.

In the event that the product is not in good condition and the causes are not due to the customer, the customer will have the right to return the product at no cost, informing BRILDOR SL of the reason for the return through any of the means provided in these terms and conditions. This kind of return due to a defect or poor condition of the product will not be considered a right of withdrawal.

BRILDOR SL undertakes to bear the cost of the return and to replace the product with a new one in accordance with the conditions accepted at the time of sale.

14. Submission to Jurisdiction

Likewise, BRILDOR SL reserves the right to bring any civil or criminal actions it deems appropriate for the improper use of its website and content or for the breach of these conditions.

The relationship between the user and the provider shall be governed by the regulations in force and applicable in Spanish territory. Should any dispute arise, the parties may submit their conflicts to arbitration or go to the ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard. BRILDOR SL is domiciled in ALICANTE, Spain.
